31. Terms
1.1 Down payment: 50% of the Retreat price, which applies as a deposit for participation in the Retreat.
1.2 General Terms and Conditions: these general terms and conditions used by The Yoga Academy, which are published on the website of The Yoga Academy, can be downloaded here.
1.3 Participant: the person of 12 years or older who wants to follow or wants to follow a course at or by The Yoga Academy Workshop, Training or Retreat. Young people between 12 and 18 years old can, in principle, only participate under the supervision and responsibility of a Participant of 18 years or older. Registration and payment must be made in the aforementioned situation by, at least with the consent of the parent / legal representative.
1.4 The Yoga Academy is located in Amstelveen at the Ouderkerkerlaan 15 and is registered in the trade register under number 55769721.
1.5 multi-ride card: a 10 lesson card, as referred to in Article 3.3.
1.6 Subscription / membership: a subscription to be issued or issued by The Yoga Academy, and to be paid or paid by a Student, subscription / membership for attending the yoga and other classes at The Yoga Academy mentioned on the regular class schedule can be found on the website (further: ‘Subscription’).
1.7 Single Lesson: a one-off lesson to be paid and followed by a Student at The Yoga Academy, other than on the basis of a Membership.
1.8 Retreat price: the total price of the Retreat, including the Down payment.
1.9 Retreat: one by The Yoga Academy Retreat.
1.10 Student: the person of 12 years or older who takes or wishes to take classes at The Yoga Academy Young people between 12 and 18 years old can only take classes under the supervision and responsibility of a Student of 18 years or older. Registration for and payment of a separate lesson, ten-ride card or subscription must be done by a young person named above, at least with the permission of the parent / legal representative.
1.11 Website: the website of The Yoga Academy www.theyogaacademy.nl
1.12 Workshop: giving or given a workshop at or by The Yoga Academy.
1.13 Training: giving or given training at or by The Yoga Academy.
1.14 Partners: third parties (natural or legal person) who give an assignment to The Yoga Academy.
2. Applicability
2.1 The General Terms and Conditions apply to all offers, quotations, assignments, legal relationships and agreements, whatever their name is, whereby The Yoga Academy commits / will undertake to perform work, including the; Subscriptions, Individual Lessons, Workshops, Training, Retreats and other student visits, whether or not through Partners of The Yoga Academy or at The Yoga Academy. By participating in a (Separate) Lesson, Workshop, Training or Retreat, the Student or Participant declares to agree with the applicability of these General Terms and Conditions. Partners of The Yoga Academy undertake to make their Students / Participants in the activities that The Yoga Academy will perform for them aware of the applicability and content of these conditions, in particular of Article 13.
2.2 The Yoga Academy can change these Terms and Conditions. The latest version of the General Terms and Conditions is always the applicable version and is available on the Website. The Yoga Academy announces any changes to the General Terms and Conditions by e-mail in advance.
2.3 These General Terms and Conditions also apply to any additional or follow-up orders.
2.4 The applicability of the General Terms and Conditions of Partners is hereby expressly rejected
2.5 These General Terms and Conditions can also be invoked by natural and legal persons who are directly or indirectly involved in any way whatsoever, whether or not on the basis of an employment contract, in the services of The Yoga Academy.
3. Subscriptions, trip card and individual lessons
3.1 Students can take classes based on a subscription or a ride card. Individual lessons are also available.
3.2 A subscription is concluded at the moment that The Yoga Academy has received the due membership fee / monthly amount from the Student.
3.3 The Yoga Academy issues the following subscriptions and cards, at the Student’s option:
MONTHLY RENTAL UNLIMITED
This subscription entitles you to an unlimited number of lessons based on availability, see article 5.
Validity: continuous.
The cancellation period is one whole calendar month. This means that the membership must be canceled before the first of the month. This can be done by email to info@theyogaacademy.nl. The cancellation is definitive when you receive an email from us indicating that we have received your cancellation.
YEAR SUBSCRIPTION
This subscription entitles you to an unlimited number of lessons based on availability, see article 5.
Validity: 1 year.
MULTI-RIDE CARD
This card entitles you to 10 lessons. The lessons must be used within 3 or 4 months respectively
SINGLE LESSON
This is a one-off payment to be made by a Student (whether or not through a partner of The Yoga Academy) and to be taken at The Yoga Academy other than on a subscription basis.
3.4 Prior to each lesson, workshop or training, the Student must report to the reception of The Yoga Academy. After the employee of The Yoga Academy has checked the registration and payment for the lesson in question, the Student gets access to the lesson.
4. Payment, Price Change and Term of View
4.1 A Subscription, Trip card, Workshop, Training or Single Lesson must be paid in advance, namely prior to the subscription period, Lesson, Workshop or Training. Payment can be made via iDEAL (online), bank transfer, Paypall or direct debit. Upon payment of the aforementioned invoice amount, the Student gives permission to The Yoga Academy for automatic collection of the follow-up periods until further notice. The automatic collection takes place on the date of registration and every month.
4.2 If the installment payment cannot be debited, for example because there is insufficient balance in the specified bank account at the time of debiting or because the Student has provided incorrect payment information, and in the event that a Student cancels the payment for a period, the Students no longer reserve online ex article 5 of the General Terms and Conditions. The Student remains liable for all due installments until the moment that the Membership has ended in accordance with the conditions.
4.3 The applicable prices for Lessons, Memberships, Workshops and Training are always on the Website and can be viewed at the reception of The Yoga Academy. The Yoga Academy reserves the right to change the prices of the lessons, workshops, training courses and other products and services. Any changes are announced in advance in The Yoga Academy and / or by mentioning on the Website, and / or by e-mail.
4.4 The Yoga Academy offers new Students who take out a Subscription via the website the opportunity to dissolve the agreement free of charge within 7 days. The Yoga Academy will then refund the Student the invoice amount as described in article 4.2 pro rata to the Student within 7 days. If the Student has not used the Subscription, the full invoice amount will be refunded. If the Student has made use of the Subscription, that is to say: the Student has participated as a minimum in a Lesson, the invoice amount will be refunded in proportion to the number of days after which it is dissolved. The trial period only applies to new Students, ie: Students who take out the Subscription for the first time.
4.5
1. If the Student, Participant or Partner has not paid within the agreed period, he / she is legally in default and The Yoga Academy is entitled to charge the statutory (commercial) interest from that moment on.
2. If the Student, Participant or Partner has not paid within the period specified in the first paragraph, he / she is obliged to reimburse all judicial and extrajudicial (collection) costs incurred by The Yoga Academy. The reimbursement of the costs incurred is not limited to any costs order determined by the court.
5. The following rules apply to the online reservation of lessons by Students with a Subscription, Multi-Ride Card or Single Lesson:
• All lessons can be booked online from 14 days in advance up to 5 minutes before the start.
• You can only book online, not by telephone or at the reception.
• Your reservation is valid until 5 minutes before the lesson starts. If you are not there yet, we will assume that you will not come and we will give the lesson to someone else. Such a ‘no show’ is administered as a lesson with a ride card and deducted as such from the ride credit on the card.
• If you want to cancel your reservation, you can do so up to 60 minutes before the start of the lesson by clicking on “cancel” in your account for the relevant lesson.
6. Timetable
6.1 The applicable class schedule is always on the Website. The Yoga Academy reserves the right to change the class schedule at any time. Possible changes are, as far as possible, announced in advance in The Yoga Academy, mention on the Website and / or by e-mail.
6.2 The Yoga Academy reserves the right (due to force majeure) to cancel a scheduled class or to change the teacher named on the class schedule. In the aforementioned situations there is no refund of money paid.
6.3 The Yoga Academy is almost always open, but reserves the right to close its doors on (public) days. In the aforementioned situation there is no refund of money paid.
7. Termination and Suspension of Subscription
7.1 The Student can always terminate a valid monthly subscription indefinitely. The cancellation period is one whole calendar month. This subscription must be canceled before the first of that full calendar month. There is no refund of Subscription Fee.
8. Participation and Payment Workshop, Training or Retreat and Registration Fee
8.1 A Participant can participate in a Workshop or Training after The Yoga Academy has received the full amount for participation in the Workshop or Training.
8.2 When participating in a Retreat, the deposit must be paid no later than 60 days before the planned Retreat. The remaining amount of the total Retreat Price must be paid to The Yoga Academy no later than 30 days before the planned Retreat. A participant can participate in a Retreat after the participant has paid the full Retreat Price.
8.3 For some Workshop (s), Training and Retreats, a so-called “early registration discount” applies. This reduced rate is valid until the date stated on the Website. After this date, the normal rate also applies on the Website.
9. Workshop: Schedule and Cancellation
9.1 The applicable Workshop timetable is always on the Website. The Yoga Academy reserves the right to change the schedule at any time. Any changes are, as far as possible, announced in advance in The Yoga Academy, and / or mention on the Website and / or by e-mail.
9.2 The Yoga Academy reserves the right to cancel a planned Workshop due to force majeure. In that case the registration fee already paid will be refunded to the Participant.
9.3 The Participant can cancel his registration free of charge up to one (1) month before the planned Workshop date. This can be done by e-mail to info@theyogaacademy.nl.
9.4 The Participant can cancel his registration up to 14 days before the planned Workshop, in which case the registration fee will be reimbursed withholding of € 10,- administration fee.
9.5 If the Participant cancels his registration within 14 days for a planned Workshop, no registration fee will be refunded.
10. Retreat: Cancellation
10.1 Cancellation of participation in the planned Retreat can only be done in writing. This can be done by e-mail to info@theyogaacademy.nl.
10.2 The Participant may cancel his registration free of charge up to 60 days before the planned Retreat.
10.3 The Participant may cancel his registration within 60 days prior to the planned Retreat Date, in which case 50% of the Retreat Price will be charged.
10.4 If the Participant cancels his registration within 14 days before the start of the Retreat, the already paid Retreat Price will not be refunded.
10.5 If the Participant on site, for whatever reason, cannot participate in the Retreat, the already paid Retreat Price will not be refunded.
10.6 The Yoga Academy reserves the right to cancel the Retreat due to insufficient participants. In that case, the Retreat Price already paid (in part) by the Participants will be reimbursed.
11. Training
11.1 Different conditions apply to Teacher Training.
12. House rules
12.1 All Students and Participants must always follow the house rules of The Yoga Academy:
If you are on a bicycle, park it in a place and in a way that does not bother other visitors and residents of The Yoga Academy.
Do not cause noise nuisance for local residents upon arrival and departure of The Yoga Academy.
Do not eat or eat lightly for 2 hours before class and do not practice yoga on a full stomach.
Come to class fresh and preferably use odorless deodorant, preferably no perfume or other scents, and no spray deodorant in the changing rooms.
Wear clean and comfortable clothing.
Take off your shoes in the arrival hall.
The Yoga Academy makes yoga mats available for use during class. This mat must always be cleaned and cleaned by the Student after use.
For an optimal rest, Students and Participants are asked not to talk in the room during and after the lessons and Workshops and only to talk softly in the other rooms. Telephones are not allowed in the room.
Sexual behavior or sexual behavior is not tolerated by The Yoga Academy. The (physical) integrity of Students and Participants must always be respected.
Feedback in any way to The Yoga Academy, teacher or fellow student is deemed to be communicated personally, discreetly and respectfully.
12.2 The Yoga Academy reserves the right for Students and Participants who, in its opinion, do not comply with the house rules as referred to in Article 12.1, to deny access to The Yoga Academy and / or terminate the Student’s Subscription or the Participant’s access. to deny the Workshop without repayment of any monies already paid.
13. Liability
13.1 The Yoga Academy accepts no liability whatsoever for physical and / or mental injury or injury, loss or damage, related to a visit to The Yoga Academy following classes and / or participation in Workshops, Training, Events and / or Retreats at , or provided by, The Yoga Academy.
13.2 The Yoga Academy works with qualified teachers and always provides high-quality Lessons and Workshops. There is nevertheless the chance of an injury or injury during a lesson or workshop. By visiting The Yoga Academy, participating in a Lesson, Workshop, Training, Event or Retreat at, or provided by The Yoga Academy, the visitor, Student and Participant accepts this risk of injury and / or injury. The Yoga Academy recommends the following to reduce the risk of injury or injury:
Consult a doctor before you start taking lessons if you are not sure that you are completely healthy or if you are pregnant.
If you have an injury or other physical discomfort, always report this to the relevant teacher before the start of the lesson, Workshop, Training or Retreat.
Listen carefully to the instructions of the relevant teacher and follow them.
Listen carefully to the signals from your body and act accordingly.
Perform the exercises carefully and take into account your physical limitations.
Do not perform exercises that are painful for you.
Ask questions when you do not understand an exercise.
Do not perform any reverse postures during menstruation or pregnancy. Intense breathing exercises are also not recommended.
13.3 A visit to The Yoga Academy, our Lessons, Workshops, Training and Retreats are not a substitute for therapy or other medical treatment or diagnosis. If you have or have received medical treatment or therapy in the past or present for mental health issues, our Lessons, Workshops, Training and Retreats may not be suitable for you. Contact your doctor or (treating) specialist with the question of whether attending or participating in the Lesson, Workshop, Training or Retreat is suitable for you at the moment.
13.4 Partners undertake to carry out the work referred to in paragraphs 1 to 3 of this article for the activities by adequately insuring The Yoga Academy and indemnifying The Yoga Academy for liability for participants of the activity, see article 13.1.
14. Personal Information
14.1 The Yoga Academy collects personal data from its visitors, the Students and Participants for the maintenance of its file, for the execution of payment orders and for the administration. The Yoga Academy handles this collection of personal data with care and processes it within the frameworks of applicable laws and regulations, including at least the laws and regulations in the field of data protection, such as the General Data Protection Regulation (AVG).
14.2 The Yoga Academy also uses the personal data referred to in Article 14.1 to inform visitors, Students and Participants of activities of The Yoga Academy and any changes to, for example, the class schedule. If one does not appreciate receiving communication from The Yoga Academy, this can be communicated in writing via e-mail to: info@theyogaacademy.nl. The visitor, Student and Participant is aware that in that case it may not be possible to use all services and products of The Yoga Academy.
14.3 The Yoga Academy never passes on the personal data of Students and Participants to third parties without prior permission.
14.4 The privacy statement sets out which data is processed by The Yoga Academy, for what purposes The Yoga Academy does and how the personal data is handled. In addition, it is explained in which way data subjects can exercise their rights to the processing of their personal data.
15. Applicable law and dispute settlement
15.1 Only Dutch law applies to the General Terms and Conditions.
15.2 Any disputes related to the General Terms and Conditions, a Subscription, Workshop, Training or Retreat, or taking lessons or purchasing other products and services from or at The Yoga Academy will in the first instance be settled by an accredited mediator in Amstelveen. If it is not possible to reach a satisfactory solution for both parties with a recognized mediator, the dispute will be settled at the competent court in Amsterdam.
